OVERVIEW
Article 1 - Definitions
In these terms and conditions, the following definitions apply:
Cooling-off period: the period within which the consumer may exercise the right of withdrawal;
Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur;
Day: calendar day;
Continuing transaction: a distance contract concerning a series of products and/or services, for which the delivery and/or purchase obligation is spread over time;
Durable medium: any device that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction;
Right of withdrawal: the possibility for the consumer to withdraw from the distance contract within the cooling-off period;
Entrepreneur: the natural or legal person who offers products and/or services to consumers remotely;
Distance contract: an agreement concluded within an organized system set up by the entrepreneur for the distance selling of products and/or services, whereby exclusive use is made of one or more remote communication techniques until the conclusion of the contract;
Remote communication technique: a means that can be used to conclude a contract without the consumer and entrepreneur being in the same room simultaneously;
General terms and conditions: these General Terms and Conditions of the entrepreneur.

Article 3 - Applicability
These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed, before concluding the contract, where these terms can be consulted and that they will be sent free of charge upon request.
If the contract is concluded electronically, the text of these terms can also be made available electronically in a way that allows the consumer to easily store them on a durable medium.
In case specific product or service conditions apply in addition to these general conditions, the consumer can always rely on the most favorable provision in case of conflict.
If any provision of these terms is invalid or annulled, the remaining provisions will remain in effect and will be replaced by a valid provision closely matching the original intent.
Situations not covered by these terms shall be assessed "in the spirit" of these terms.
Uncertainties about the interpretation or content of one or more provisions shall also be interpreted "in the spirit" of these general terms.
Article 4 - The offer
If an offer has a limited validity period or is subject to conditions, this will be explicitly stated.
The offer is non-binding. The entrepreneur has the right to change and adapt the offer.
The offer contains a complete and accurate description of the products and/or services offered, detailed enough to enable the consumer to assess it properly.
If the entrepreneur uses images, they truthfully represent the products and/or services offered. Obvious errors in the offer are not binding.
All images, specifications, and data in the offer are indicative and cannot be grounds for compensation or contract termination.
Each offer clearly states the rights and obligations involved in accepting it, such as:
- the price (excluding customs and import VAT, which are at the customer's expense and risk),
- any shipping costs,
- the method of concluding the contract,
- whether the right of withdrawal applies,
- the method of payment, delivery, and execution,
- the acceptance period,
- any applicable codes of conduct,
- and the minimum contract duration for continuing transactions.
Article 5 - The contract
Subject to the provisions of paragraph 4, the contract is concluded when the consumer accepts the offer and meets the stated conditions.
If the consumer accepts electronically, the entrepreneur will confirm receipt electronically. Until confirmed, the consumer may cancel the contract.
When concluded electronically, the entrepreneur will take appropriate measures to secure data transfer and provide a secure online environment.
The entrepreneur may check the consumer’s creditworthiness and refuse or impose conditions if there are valid reasons.
With the product or service, the entrepreneur will provide written information on:
- the business address for complaints,
- conditions for exercising the right of withdrawal or a clear statement if it’s excluded,
- information on warranties and after-sales services,
- data required under Article 4, unless already provided.
Article 6 - Right of withdrawal
Upon purchasing products, consumers have 14 days to dissolve the contract without giving reasons. The cooling-off period starts the day after receiving the product.
During this period, the consumer must handle the product and packaging carefully, unboxing it only as necessary to decide whether to keep it.
To exercise the right, the consumer must notify the entrepreneur within 14 days, then return the product within another 14 days.
If the consumer fails to notify or return within these periods, the purchase is final.
Article 7 - Costs in case of withdrawal
If the right of withdrawal is exercised, the return costs are borne by the consumer.
Refunds will be processed within 14 days of withdrawal, provided the product has been returned or proof of shipment supplied.
Article 8 - Exclusion of the right of withdrawal
The entrepreneur may exclude withdrawal rights for products:
- custom-made according to consumer specifications,
- of a clearly personal nature,
- that cannot be returned due to their nature,
- that deteriorate or expire quickly,
- subject to financial market fluctuations,
- individual newspapers or magazines,
- sealed audio/video recordings or software once unsealed,
- sealed hygiene products once unsealed.
Exclusion also applies to services like:
- accommodation, transport, catering, or leisure activities on a specific date,
- services started with consumer consent before the withdrawal period ended,
- betting and lotteries.
Article 9 - The price
Prices stated remain valid during the offer period, except for VAT-related changes.
Prices may vary for products subject to financial market fluctuations beyond the entrepreneur's control.
Price increases within 3 months are allowed only if legally required.
Beyond 3 months, price increases are permitted only if agreed upon and the consumer can terminate the contract if desired.
All prices are subject to printing or typographical errors; such errors are non-binding.
Article 10 - Conformity and warranty
The entrepreneur guarantees products and/or services conform to the contract, specifications, and reasonable expectations of reliability and usability.
Defective or incorrect products must be reported within 14 days and returned in original packaging.
The warranty equals the manufacturer’s warranty unless improper use, unauthorized repairs, or negligence void it.
Article 11 - Delivery and execution
The entrepreneur will take the utmost care when receiving and executing product orders.
Orders are fulfilled promptly within 30 days unless otherwise agreed. Consumers will be notified of delays and can cancel free of charge if delivery isn’t possible.
The risk of loss or damage passes to the consumer upon delivery unless agreed otherwise.
Article 12 - Duration, termination, and renewal
Consumers may terminate indefinite contracts for regular product or service delivery at any time with one month's notice.
Fixed-term contracts cannot be silently renewed unless explicitly stated, and the consumer must always be able to cancel under fair notice conditions.
Article 13 - Payment
Unless otherwise agreed, payments must be made within 7 working days of the cooling-off period's start.
Consumers must immediately report payment inaccuracies.
In case of late payment, reasonable costs previously communicated may be charged.
Article 14 - Complaints procedure
Complaints must be submitted within 7 days, described clearly and fully.
Responses will be given within 14 days; if more time is needed, the consumer will be informed.
Valid complaints entitle the consumer to replacement or free repair.
Article 15 - Disputes
Only Dutch law applies to contracts under these terms, even if the consumer lives abroad.
